What this can mean for your project

Near a nature site

Projects that could affect a Special Area of Conservation or Special Protection Area may need an appropriate assessment. This can apply even if you are outside the site.

Protected structure or conservation area

If your home is on the Record of Protected Structures, or in an architectural conservation area, many works that are normally exempt need permission. You can ask the council for a declaration under section 57.

Near a recorded monument

Applications close to a recorded monument can be referred to the National Monuments Service, which can add time and conditions.

Flood risk

The council may ask for a flood risk assessment in flood-prone areas. Check the official flood maps on floodinfo.ie.

Monaghan County Council policies to know

Rural housing around Monaghan, Carrickmacross, Castleblayney, Clones

Around these four towns (rural areas under strong urban influence), a single house is only permitted if you meet one test. You are a landowner (2 hectares or more, owned for at least 5 years) or their immediate family member. Or you have lived in the local rural area (within 4 km) for at least 5 years. Or you work in an established rural enterprise nearby and earn your main income from it. Or you are a retiring farmer or their widow or widower. Or you face compelling domestic or personal hardship. Or you are a returning emigrant who lived there for 5 continuous years. A rural housing application form is required, and an occupancy condition is attached.

Remaining rural areas are more open

Outside the settlements and the strong urban influence areas, rural housing is facilitated under the normal planning and siting rules in Chapter 15 of the plan. Small village settlements (Tier 5 and 6) are encouraged as an alternative to one-off rural houses, and need no rural housing need test if they are in strong urban influence areas.

Restoring or replacing traditional rural buildings

The council encourages restoring or adapting traditional rural buildings rather than demolishing them. Replacement is only considered if a survey shows the building cannot be made structurally sound, and the new building is normally within the old one's curtilage. If you build or restore within 100 metres of a farm building, you need the farm owner's signed written consent, and a 7-year occupancy condition applies.
