What this can mean for your project

Near a nature site

Projects that could affect a Special Area of Conservation or Special Protection Area may need an appropriate assessment. This can apply even if you are outside the site.

Protected structure or conservation area

If your home is on the Record of Protected Structures, or in an architectural conservation area, many works that are normally exempt need permission. You can ask the council for a declaration under section 57.

Near a recorded monument

Applications close to a recorded monument can be referred to the National Monuments Service, which can add time and conditions.

Flood risk

The council may ask for a flood risk assessment in flood-prone areas. Check the official flood maps on floodinfo.ie.

Limerick City and County Council policies to know

Rural housing in areas under strong urban influence

In areas under strong urban influence you must meet one test. Economic need: you have never owned a rural house and work in farming, bloodstock or another rural activity within 10 km of the site (farms need at least 12 hectares and you must have worked there for 5 years). Social need: you have never owned a rural house and want to build your first home within 10 km of where you lived for a substantial part of your life (at least 10 years). Exceptional need includes returning emigrants with 10 years' local history and people who lost a home through separation, divorce or repossession.

More open rules in the rest of the county, and a seven-year condition

In 'Rural Areas Elsewhere', demand for permanent homes is generally accommodated if normal planning and environmental rules are met, including safe access, wastewater that protects water quality, and good siting and design. Houses in the strong urban influence areas must be occupied by the applicant for seven years.

Source: Volume 1, Chapter 4, Objectives HO O20 and HO O22
Traditional rural houses: refurbish before replacing

The council prefers refurbishing traditional rural houses to replacing them. A replacement is generally only granted if the house cannot reasonably be made structurally sound and has no architectural merit. In that case, local rural housing need does not apply to the replacement.
