What this can mean for your project
Projects that could affect a Special Area of Conservation or Special Protection Area may need an appropriate assessment. This can apply even if you are outside the site.
If your home is on the Record of Protected Structures, or in an architectural conservation area, many works that are normally exempt need permission. You can ask the council for a declaration under section 57.
Applications close to a recorded monument can be referred to the National Monuments Service, which can add time and conditions.
The council may ask for a flood risk assessment in flood-prone areas. Check the official flood maps on floodinfo.ie.
Louth County Council policies to know
Louth has two rural policy zones, both under strong urban influence. Zone 1 also has significant landscape value (including Carlingford Lough and Mountains and the Brú na Bóinne area). In Zone 1 you qualify if you are in full-time agriculture, a son or daughter of a qualifying landowner building a first home, run a business that depends on the location, have exceptional health reasons, provide care to an isolated rural resident, or lost a home through separation or repossession after 10 years' residence. A qualifying landowner owns at least 1.5 hectares and has owned it for at least 15 years, and no more than three houses are allowed on the holding.
Source: Chapter 3, section 3.17.4, Tables 3.3 and 3.4, Policy Objective HOU 43In Zone 2 you qualify if you are in full-time agriculture, run a business that needs you to live in the rural area, or are a landowner (or their son or daughter) with ties to the area, or are building your first house with a demonstrable economic or social requirement. Social ties normally mean living in the rural area of Louth for at least 18 years before applying. You must show a rural housing need and not own or have sold a home in the county. The site is not normally more than 6 km from the qualifying family home.
Source: Chapter 3, section 3.17.4, Table 3.5New rural dwellings, and new homes in Level 5 settlements, are subject to a 7-year occupancy condition, in the form of a Section 47 agreement, restricting the use to the applicant or others who meet the criteria. There is a presumption against a one-off house in Zone 1 where there is an alternative site on family land in Zone 2. The council restricts building on land with a history of speculative site sales.
