What this can mean for your project

Near a nature site

Projects that could affect a Special Area of Conservation or Special Protection Area may need an appropriate assessment. This can apply even if you are outside the site.

Protected structure or conservation area

If your home is on the Record of Protected Structures, or in an architectural conservation area, many works that are normally exempt need permission. You can ask the council for a declaration under section 57.

Near a recorded monument

Applications close to a recorded monument can be referred to the National Monuments Service, which can add time and conditions.

Flood risk

The council may ask for a flood risk assessment in flood-prone areas. Check the official flood maps on floodinfo.ie.

Wicklow County Council policies to know

Rural housing needs a functional social or economic reason

The council facilitates homes in the open countryside for people with a housing need based on a demonstrable functional social or economic need to live there. Housing need means a clear need for a new home, such as a first-time buyer, someone who lost a previous home through separation, divorce or repossession, or someone needing a purpose-built adapted home for a verified medical condition.

Source: Chapter 6, Policy CPO 6.41 and Table 6.3 Rural Housing Policy
Economic need: a livelihood that depends on living in the countryside

Economic need applies where your livelihood is intrinsically linked to the rural area and a home in the countryside is essential to it, for example a significant farm enterprise that needs a dwelling on the holding, or other full-time work that requires you to live in that rural area rather than a nearby settlement. If you are starting a new rural enterprise with no experience, it must have run legally and continuously for at least 5 years and be your main income. Businesses that are not location-dependent are not considered.

Source: Chapter 6, Table 6.3, Economic Need
Social need: native residents and family links

Social need covers permanent native residents of the rural area (born and reared there), former natives returning, a close relative who inherited a holding or site, a son or daughter of a landowner whose land has been in the family for at least 10 years, local applicants with an affordable local site, carers, and people with other strong local ties. In a conflict with other settlement and landscape rules, a person who qualifies under CPO 6.41 takes priority, except where the site would be a likely traffic or public health hazard.
